Terms of Service

Important: CareNod is not an emergency service and not a medical device. Alerts can be delayed or missed, for example if a phone is off, out of battery or offline. In an emergency, always call your local emergency number.
1. About these terms
These terms are an agreement between you and [OPERATOR LEGAL NAME], [POSTAL ADDRESS] ("CareNod", "we", "us"). By creating an account you agree to them and to our Privacy Policy. If you don't agree, please don't use CareNod.
2. What CareNod does, and doesn't do
CareNod lets a person (the "care receiver") check in daily, ask for help with an SOS button, and optionally share their location and medicine reminders with family members they choose ("caregivers"). CareNod tells caregivers when something may need their attention.
CareNod does not contact emergency services, monitor anyone around the clock, diagnose, treat or prevent any medical condition, or guarantee that any alert will be delivered on time. It depends on phones, batteries, networks and third-party services that we don't control. Please don't rely on CareNod as the only way to keep someone safe.
3. Who can use CareNod
You must be at least 18 years old (or the age of majority where you live) to create an account. Each account is for one person; keep your email account secure, as it is used to sign in.
4. Consent of the person being looked after
CareNod is built on trust. You may only invite someone as a care receiver if they know about CareNod and agree to use it. You must not use CareNod to monitor anyone secretly, without their agreement, or against their wishes. The care receiver controls their own location sharing and medicine reminders, and can leave their circle or delete their account at any time.
If someone isn't able to agree for themselves (for example because of advanced dementia), only a person with legal authority to make decisions for them may set CareNod up on their behalf, and must act in their best interests.
5. Acceptable use
You agree not to: use CareNod to stalk, harass or control anyone; misuse the SOS feature; interfere with or try to break into the service; access data you're not entitled to; or use CareNod for anything unlawful. We may suspend accounts that do.
6. Free and Premium
Daily check-ins, missed check-in alerts and SOS are free. CareNod Premium is a paid subscription that adds features for everyone in one family circle, as described in the app.
- Billing: Premium is sold through Google Play (and, later, the Apple App Store). The store takes payment and its terms also apply.
- Free trial: if offered, you are charged when the trial ends unless you cancel at least 24 hours before.
- Renewal: subscriptions renew automatically each month or year until cancelled.
- Cancelling: cancel any time in Google Play → Payments & subscriptions. Premium stays active until the end of the period you paid for. Deleting your CareNod account does not cancel a subscription.
- Refunds: handled by Google Play under its refund policy. This doesn't affect your statutory rights.
- Price changes: we'll give you notice through the store before a new price applies, and you can cancel before it does.
If Premium ends, nothing is deleted and nobody is removed; Premium features simply stop until it's renewed.
7. Your content and data
You own the information you put into CareNod. You give us permission to use it only to provide CareNod to you and your family circle, as described in the Privacy Policy. You can download or delete it at any time.
8. Changes to CareNod and these terms
We're always improving CareNod and may change or remove features. If we make important changes to these terms, we'll tell you in the app beforehand and ask you to agree again. If you don't agree, you can stop using CareNod and delete your account.
9. Our responsibility to you
We provide CareNod with reasonable care and skill, but because of the limits described in section 2, we provide it "as is" and can't promise it will always be available, uninterrupted or error-free.
To the extent the law allows, we are not responsible for losses that result from an alert being delayed, missed or not acted on, or from relying on CareNod instead of contacting emergency services. Our total responsibility to you for any claim is limited to the amount you paid us in the 12 months before the claim.
Nothing in these terms limits responsibility that can't be limited by law, such as for death or personal injury caused by negligence, or for fraud, or your rights as a consumer.
10. Ending your use
You can stop using CareNod and delete your account at any time in Settings. We may suspend or close accounts that break these terms, with notice where reasonable.
11. Governing law
These terms are governed by the laws of [GOVERNING LAW]. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring claims in your local courts.
